TERMS AND CONDITIONS (PUBLIC OFFER)
Introduction
By accessing this website and booking the Photographer’s services, you agree to these Terms and Conditions. In the event of a specific Service Agreement (e.g., for commercial or large-scale projects), the terms of that individual contract shall prevail over this Public Offer.
1. Booking and Payment
To secure your photoshoot date, a 50% non-refundable deposit (Acompte) is required at the time of booking. This deposit confirms the firm commitment of both parties. The remaining 50% (Service Fee) must be paid no later than the day of the photoshoot, prior to the commencement of the session.
2. Right of Withdrawal (Droit de Rétractation)
In accordance with Article L221-18 of the French Consumer Code, the Client has a period of 14 days to withdraw from this contract without penalty. However, if the Client requests the photoshoot to take place before the end of this 14-day period, they explicitly waive their right of withdrawal once the service has been fully performed.
3. Rescheduling and Cancellation
- Rescheduling: Requests to change the date must be made at least 14 days before the scheduled session. Rescheduling is subject to the Photographer’s availability.
- Cancellation by Client: In the event of cancellation, the 50% Acompte (deposit) remains with the Photographer as compensation for the reserved time slot and administrative costs.
- Cancellation by Photographer: If the Photographer is unable to perform due to illness or Force Majeure, a replacement of equal professional standing will be offered. If no replacement is found, a full refund of all payments received (including the deposit) will be issued.
4. Liability and Force Majeure
- Force Majeure: Neither party shall be held liable for failure to perform their obligations if such failure is the result of a Force Majeure event as defined by Article 1218 of the French Civil Code (e.g., natural disasters, strikes, government restrictions).
- Technical Failure: In the event of equipment malfunction or data loss, the Photographer’s liability is strictly limited to a refund of the fees paid for the affected portion of the service. The Photographer is not liable for third-party costs (e.g., makeup, travel, rentals).
5. Intellectual Property
- Copyright: The Photographer retains all moral and economic rights to the images (Droit d’auteur) under the French Intellectual Property Code.
- Usage License: The Client is granted a non-exclusive, non-commercial license for personal use (private display, personal social media). This license is valid worldwide for the duration of the copyright. Any commercial use or transfer to third parties requires a separate written agreement.
- Deliverables: Only curated, edited images are delivered. RAW files remain the property of the Photographer and are not provided unless a “Buyout” agreement is signed.
6. Governing Law and Disputes
These terms are governed by French law. In the event of a dispute, the parties agree to seek an amicable solution. If no agreement is reached, the Client has the right to contact a consumer mediator (Médiateur de la consommation). All legal proceedings shall be brought before the courts of Paris.
